What is Paul Miller’s Law?
Named in memory of Paul Miller Jr., who tragically lost his life in 2010 due to a distracted driver, this law bans the use of handheld interactive mobile devices—such as smartphones, tablets, and similar electronics—while operating a motor vehicle. This prohibition applies even when temporarily stopped at traffic lights, stop signs, or in traffic. The law defines “use” as holding a device, pressing more than a single button, or reaching for it in a way that causes the driver to leave the proper seated driving position.
Key Details:
- Effective Date: June 5, 2025
- Enforcement: From June 5, 2025, to June 5, 2026, law enforcement will issue written warnings for violations. Starting June 5, 2026, violations will result in a $50 fine, plus court costs and fees, which could total approximately $198.50.
- Exceptions: Drivers may use hands-free technology (e.g., Bluetooth, speakerphone, or mounted GPS devices) or use a device when the vehicle is safely parked off the road. Emergency use, such as contacting 911, is also permitted.
- Penalties for Serious Offenses: If distracted driving leads to a homicide by vehicle conviction, an additional five-year prison sentence may be imposed.
